Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Frontier AI Inc. ("we", "us", "our") regarding your use of our website, platform, and application programming interface (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy.

2. Your account

To use the Services you must create an account. You are responsible for safeguarding your credentials and for all activity that occurs under your account. You must provide accurate information and notify us promptly if you believe your account has been compromised.

You must be at least the age of majority in your jurisdiction, or use the Services through a parent or guardian's agreement, to create an account.

3. Acceptable use

You agree not to misuse the Services. Without limiting the general prohibition, you may not use the Services to:

• Violate any applicable law, regulation, or third-party right.
• Generate, share, or distribute content that is unlawful, harmful, hateful, or that exploits or endangers others.
• Attempt to access the Services in unauthorized ways, including bypassing rate limits or authentication controls.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the models.
• Interfere with the integrity or availability of the Services.

4. API terms

Your use of our API is subject to the API documentation, including any rate limits and usage requirements described there. You are responsible for the content your applications generate using the API and for ensuring your use complies with these Terms. We may suspend or limit API access if we detect abuse or a violation of these Terms.

5. Fees and billing

Some features require payment of fees. Unless otherwise agreed, fees are billed in advance and are non-refundable except as required by law. You are responsible for all taxes. We may change fees or introduce new fees by providing notice, and continued use of the Services after the change constitutes acceptance.

6. Intellectual property

We retain all rights in the Services, including the models, software, and documentation. You retain rights in the content you submit and the outputs you generate. To the extent any intellectual property in your content is needed to provide the Services, you grant us a limited license to use it for that purpose.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Model outputs may be inaccurate, incomplete, or outdated, and you are responsible for verifying their accuracy before relying on them.

8. Limitation of liability

To the maximum extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total aggregate liability will not exceed the amounts you paid us in the twelve months preceding the claim.

9. Termination

You may stop using the Services at any time and may delete your account through your account settings. We may suspend or terminate your access if you violate these Terms, and will give you reasonable notice where practicable. Sections that by their nature should survive termination will survive.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in San Francisco, California, and you consent to the jurisdiction of those courts.

11. Changes to these terms

We may update these Terms from time to time. We will provide notice of material changes, and the updated Terms will be effective on the date posted. Your continued use of the Services after any change constitutes acceptance of the revised Terms.
